The Mohala Intelligence (the "Service") is operated by Mohala Health Group LLC, a Hawaiʻi limited liability company with principal offices in Honolulu, Hawaiʻi ("Mohala", "we", "us"). By creating an account, accessing, or using the Service you agree to these Terms.

You must be at least 18 years old. If you accept these Terms on behalf of an organization, you warrant that you have authority to bind that organization, and references to "you" apply to both you and that organization.

Mohala provides commercial intelligence modules built on the Hawaiʻi Health Intelligence Platform (HHIP), including audited evidence chains, module-specific dashboards, exports, and API access according to your subscription tier. The Service is delivered on a best-efforts basis and is not warranted to be uninterrupted or error-free.

You will not, and will not permit any third party to:

• use the Service for any unlawful, fraudulent, or deceptive purpose;
• infringe any intellectual-property or privacy rights of any party;
• interfere with the integrity or security of the Service (including malware, probing, or unauthorized scraping beyond rate-limited public APIs);
• resell, sublicense, or redistribute the Service or its outputs except as expressly permitted by your tier;
• use the Service to make automated decisions affecting individuals' care, employment, or insurance status without independent human review.

You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at david@mohalaintelligence.comif you suspect unauthorized access.

Mohala and its licensors retain all right, title, and interest in the Service, including the HHIP schema, audited evidence chain methodology, module software, branding, and documentation. Subject to these Terms and your subscription, Mohala grants you a limited, non-exclusive, non-transferable right to use the Service. Public-record source data ingested into HHIP remains the property of its originating agencies; Mohala's licensable interest is in the integration, normalization, and audit chain.

Mohala Health Group LLC is the merchant of record for all subscriptions and one-time purchases. Payments are processed by Stripe, Inc. on our behalf; your payment-method details are submitted directly to Stripe and are never stored on our servers. Charges on your statement appear under "Mohala Health Group" or a similar descriptor.

Prices are listed in U.S. dollars. Where required by law, applicable sales tax, VAT, or GST is calculated at checkout and added to the displayed price; Mohala Health Group LLC is responsible for collecting and remitting those amounts to the appropriate authorities.

Subscriptions auto-renew at the end of each billing period unless canceled. You can cancel anytime from your billing portal; access continues to the end of the period you paid for. See our Refund Policy for refund details.

We may suspend or terminate your access if (a) you materially breach these Terms, (b) any payment is not received and remains unpaid after Stripe's automatic retry schedule has been exhausted, (c) we identify a credible security or fraud risk, or (d) we are required to do so by law. We will give reasonable notice except where doing so would create risk to the Service or other customers.

Each party will protect the other's non-public information disclosed under these Terms using at least the same degree of care it uses for its own confidential information, and will not use it except to perform under these Terms.

Outputs of the Service — including evidence chains, AI-assisted drafts, ROI estimates, and benchmarks — are provided for informational purposes and do not constitute legal, medical, financial, or regulatory advice. To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose.

To the fullest extent permitted by law, Mohala's aggregate liability arising out of or relating to these Terms will not exceed the fees you paid for the Service in the twelve months preceding the claim. Mohala will not be liable for indirect, consequential, special, or punitive damages, including loss of profits, data, or goodwill. Nothing limits liability for fraud, willful misconduct, or where exclusion is prohibited by law.

You will indemnify Mohala from third-party claims arising from your unlawful use of the Service, your breach of these Terms, or content you upload to the Service.

These Terms are governed by the laws of the State of Hawaiʻi, without regard to conflicts-of-law principles. The exclusive venue for disputes is the state and federal courts located in Honolulu, Hawaiʻi.

We may update these Terms by posting a revised version with a new "Last updated" date. Material changes will be notified by email or in-product notice at least 14 days in advance. Continued use after the effective date constitutes acceptance.
